Government Affairs and Legal News:

United States Court of Appeals Denies Motion For Stay Sets Dates for Full Briefing

As discussed before, ASA brought a legal action in the US Court of Appeals regarding the legality of the documentation requirements of MAG 6. ASA asked for a Motion to Stay and Summary Judgement. Both Motions were denied and the Court has scheduled brief filing dates. There are many document filing dates associated with the lawsuit and the last filing date is December 7, 2016. Oral arguments would be set after that date. ASA had hoped for the Motion to Stay but in the end the court stated the requirements to stop a government action without a full hearing are stringent. It is hard to even rewrite this stuff as any person would realize the law should protect the people and unnecessary, non-critical, non-safety government rules should only be created under the most stringent of circumstances. ASA thought the FAA would do right and fix the problem they created, which provides no benefit to safety whatsoever. ASA will keep members up-to-date on any news from FAA or EASA. As far as the case, there will be no news until the briefs are filed and argued.

 

More FAA Guidance Creates More Confusion

The FAA has issued new guidance that interprets the Maintenance Annex Guidance (MAG). At first, it looks like it is going to fix some of the problems. And just when it looks like the problems might be fixed, it throws us a curve ball with a limitation that appears to once again work to the disadvantage of distributors with new and new surplus parts. The new guidance is FAA Notice 8900.380. The key language in this new guidance states...Click here to read more.


Export Alert: New Destination Control Statement Required

Under current law, the US regulations require exporters to include a destination control statement ("DCS"), on each export control document that accompanies an export shipment.  The export control documents that are required to show this statement include the invoice, the bill of lading, the air waybill, and any other export control document that accompanies the shipment from its point of origin in the United States to the ultimate consignee or end-user abroad. FAA Releases One Unapproved Parts Notifications

These UPNs were released since the last Member Bulletin. The bulleted information is linked to the UPN. Read the UPN closely. Different offices within the FAA write these UPNs so there is different information in them, for example look for may versus did; statements that FAA has confirmed that there was a problem versus FAA thinks there may be an issue. This note of advice is true for all UPNs not just these three.

Drop Shipment Focus Group

The focus group to define the ASA-100 language for control of drop shipment has been finalized. Information will be sent to the group shortly and the groups recommendation on language will be presented during the December 1, 2016 quality committee meeting. Any questions or comments may be sent to Sam O'Connor

 

Hazmat Training Dates
The U.S. Department of Transportation requires all individuals engaged in handling hazardous materials to be trained at least once every three years. ASACB Announces AS9120B Training

ASACB is pleased to announce that our first AS9120B workshop in Dubai U.A.E was a success with positive feedback. Based on this outcome a second workshop and the first to be offered in the U.S, will be performed by Sam O'Connor and George Ringger. This workshop will focus on the expectation and requirements to transition to AS9120B. For registration and to review the agenda, please visit www.aviationsuppliers.org/Workshops.

There are only 19 months remaining for the transition to the new ISO 9001/AS9100/AS9110/AS9120 standards. Organizations that are AS9100/AS9110/AS9120 and waiting on release of the new revisions should already have or are in process of implementing the ISO9001:2015 standards new requirements. ISO 9001:20015 is the base standard for all the newly revised and pending release AS series standards. This will aid in getting your organization prepared to achieve the transition deadline of September 15, 2018 for AS9100/AS9110/AS9120.


A transition commitment letter will be sent out to all AS9100/AS9110/AS9120 organizations certified by ASACB. Per SR003 all certification bodies are required to gather letters of commitment to transition to the new revisions of the AS9100 series standard. If your company is certified by ASCB to one or more of the AS9100 series standard please return the completed letter by the due date of October 31, 2016. A copy of the letter can be downloaded from the ASA website.

ASACB Announces recent and upcoming industry meetings

On September 13-15, 2016 a joint meeting was held between the Americas Aerospace Quality Group/G-14 AAQSC and Registration Management Committee. Topics of discussion included but were not limited to standards, sanctioned training and OASIS NextGen release. All are on schedule for confirmed release dates in October, November and December of this year. To better understand certification body audit capacity and capability, the IAQG along with each regional sector has commissioned a survey to be sent out to all authenticated auditors. The purpose of the survey to better manage the transition by the deadline of September 15, 2018 and to ensure enough resources exists to allow for an achievable outcome of transition over all existing certified organizations. These questions were collaborated and defined by a dozen accredited certification bodies which included ASACB.

ASACB will be represented by Sam O'Connor. In addition to attending the meetings on the AS9100 series standards Sam will be participating on the writing team for the standard to address Unsalvageable Parts Management. ASACB will provide its certified organizations an overview of pertinent and industry information as an outcome of this meeting.
